Do California HOA Pools Require a Lifeguard?
Usually not by law. Most HOA, condo and apartment pools count as "public swimming pools" under the California Health and Safety Code, but §116045 only requires lifeguard service at public pools that charge a direct fee for swimming. Pools that don't charge a fee can instead post a sign stating that no lifeguard is on duty. Many boards, property managers and insurers still require a certified lifeguard for resident parties and organized swim events, and county health departments can add their own rules.

Does our HOA pool legally require a lifeguard in California?
Usually not.
